A recent court decision has allowed a lawsuit brought by a former firefighter in Lincolnwood to move forward, though the claim against the village itself has been dropped. The case, which involves allegations of gender discrimination and retaliation, was addressed by U.S. District Court Judge Charles Kocoras on Wednesday.

The plaintiff, Joshua Weller, worked as a firefighter/paramedic for Paramedic Services of Illinois Inc. (PSI) in Lincolnwood. He claims that he witnessed widespread discrimination against a female coworker during his time with the company. Weller’s attorney, Daniel Zemans, filed the lawsuit in August 2017, targeting PSI, the Village of Lincolnwood, and several unnamed individuals.

Following the filing, the defendants—including PSI, the village, and “Jane and John Does 1-10”—moved to dismiss the case. However, on January 18, Zemans requested to drop the portion of the suit against the village while keeping the claims against PSI. Judge Kocoras granted both requests, dismissing the count against the village without prejudice and one count against PSI, but rejecting PSI’s motion to dismiss six other claims.

According to the lawsuit, Weller faced retaliation after speaking out against mistreatment and reporting a supervisor’s drug use. He alleges that male coworkers and superiors harassed him, leading to his termination. In his ruling, Judge Kocoras noted that the complaint described a “lascivious, hostile” environment at the firehouse, which he found sufficient to support Weller’s gender discrimination claims.

However, the judge dismissed one count against PSI—intentional infliction of emotional distress—without prejudice, stating that the alleged harassment appeared to be motivated by personal gratification rather than business purposes.

Weller began working for PSI in October 2010 and was assigned to Lincolnwood in December 2015, where he remained until his dismissal in July 2016. Lincolnwood is one of the few Illinois municipalities that outsources its firefighter staffing, according to local officials. The village claims this practice helps reduce costs related to pensions and benefits.

In his complaint, Weller detailed how male coworkers subjected a female colleague to explicit verbal abuse, calling her “useless,” making lewd comments about her body, and questioning whether she was sleeping with coworkers. He also said that male coworkers referred to him as the woman’s “guard dog,” spread rumors about an affair between them, and even sent him explicit images asking if they depicted their supposed relationship.
